Paul Adam on Wills and Estates: Providing Guardianship of your Children in your Last Will

You can definitely name somebody in your last will to have custody and guardianship of your minor children in the event both of the parents pass away.

Now, the appointment you make in you last will is temporary. That person will eventually need to apply to the court to be appointed as a permanent guardian. But, when they make that application, the court will look very closely on who you named in your last will, and factor that in the decision about who should be the permanent guardian of your children.

If your employment agreement prohibits you from competing with your employer or soliciting its customers after you leave, those restrictions may not be enforceable.

NOn-competition agreements are generally unenforceable against Ontario employees.

Many non-solicitation agreements may also be unenforceable.

Seek legal advise if you have signed such an agreement.

Paul Adam on Wills and Estates: Do children inherit parent's debt?


Most debt doesn’t transfer from a parent’s estate to a child. If the deceased did not have enough assets to pay off the debts, the creditors may require a sale of the assets of the estate to address the debt, but that’s it. 

There are some exceptions- like if a child jointly owned the debt, or acted as a guarantor, or if the deceased parent improperly offloaded assets to the child for less than market value to evade creditors.

Paul Adam on Wills and Estates: Is a foreign Will valid in Ontario?


This can depend on the Will itself. Some factors to consider are: 

1. Does the Will intend to apply to property in Ontario? 

2. Can the words of the Will be interpreted conclusively? 

3. Does the Will deal with the property in a way that is legal in Ontario? 

If the Court is satisfied with the answers to all of these questions, and an executor has already been appointed outside Ontario, it may grant that executor the right to administer the deceased’s property in Ontario, too.

Paul Adam on Wills and Estates: If a family member has put money into an investment in your name and you have co-signed on changes to the investment, does the investment belong to you?


The answer will very often depend on what you and your family member intended. Did they put the investments in your name with the expectation that you would hold it for their benefit, as a convenience, or was it done with the intention that the money was to belong to you? 

Where there is a dispute, Ontario’s Courts will look at the documents or agreements you signed, the intentions of everyone involved and the surrounding circumstances to determine ownership interests.
