Paul Adam on Wills and Estates: Do children inherit parents' debt?

Most debt doesn’t transfer from a parent’s estate to a child. If the deceased did not have enough assets to pay off the debts, the creditors may require a sale of the assets of the estate to address the debt, but that’s it.

There are some exceptions- like if a child jointly owned the debt, or acted as a guarantor, or if the deceased parent improperly offloaded assets to the child for less than market value to evade creditors.

Wise Law's Employment #LawFact of the Day: Can a temporary layoff be considered a termination of employment?

Temporary layoffs of employment may not be permitted unless there is an employment contract that specifically permits such layoffs.

In most circumstances, legally permitted layoffs can only last:

A. Not more than 13 weeks of layoff in any period of 20 consecutive weeks, or

B. More than 13 weeks in any period of 20 consecutive weeks, but less than 35 weeks of layoff in any period of 52 consecutive weeks if the employer continues benefit payments or makes other substantial payment to the employee during the layoff.

If you have been laid off without contractual authorization, or

If you have not been recalled by your employer within these required timeframes,

You may be entitled to treat the layoff as a termination and to claim compensation for wrongful dismissal.

Seek legal advice to determine your rights and entitlements if you have been laid off.

Paul Adam on Wills and Estates: How important is it to have a Will if you are in your 30s and don't have many assets?

Having a Last Will is still important, even if you are young. There is no better way to provide for your family and your future.

You can create a Last Will to plan ahead for a time when you have increased assets or a larger family. Now is always a good time, because your life is only going to get more hectic!

Paul Adam on Wills and Estates: Is a foreign Will valid in Ontario?

This can depend on the Will itself. Some factors to consider are:

1. Does the Will intend to apply to property in Ontario?
2. Can the words of the Will be interpreted conclusively?
3. Does the Will deal with the property in a way that is legal in Ontario?

If the Court is satisfied with the answers to all of these questions, and an executor has already been appointed outside Ontario, it may grant that executor the right to administer the deceased’s property in Ontario, too.

Wise Law's Employment #LawFact of the Day: How much am I owed if I am fired?

The amount payable to a wrongfully dismissed employee depends on the length of employment, age, salary, and several other factors.

It can be as much as one month for each year of service, or even more in exceptional circumstances.

Paul Adam on Wills and Estates: Can I make my own Will using an online form?

Beware. If you use an online form instead of a lawyer:

1. You aren’t getting personalized advice from a lawyer who has assessed your needs and interests.

2. Nobody is proofreading the document to ensure it is error free, and captures your intentions accurately.

3. Sadly, many online will forms include mistakes some that could adversely affect the interpretation of the Will.
