Wise Law's Employment #LawFactof the Day: Returning to work from maternity or parental leave


Can an employer significantly change your job duties while you are on parental leave?

Pursuant to the Employment Standards Act, in most cases, an employee who takes pregnancy/parental leave is entitled to return to the same role or a comparable role the employee had before the leave began, or a comparable role if the employee’s former position no longer exists.

If an employee experiences significant changes to the terms of their employment, then they may be entitled to bring a claim for constructive dismissal.

Paul Adam on Wills and Estates: Do children inherit parent's debt?


Most debt doesn’t transfer from a parent’s estate to a child. If the deceased did not have enough assets to pay off the debts, the creditors may require a sale of the assets of the estate to address the debt, but that’s it. 

There are some exceptions- like if a child jointly owned the debt, or acted as a guarantor, or if the deceased parent improperly offloaded assets to the child for less than market value to evade creditors.

Wise Law's Employment #LawFactof the Day: How to resign the right way?


An employee is obligated to give reasonable notice of intention to resign from his or her position of employment.

The amount of notice to be given will depend on a number of factors including any provision in an employment agreement that sets out the amount of notice of resignation that is required.

Where there is no employment agreement that provides for resignation by employee, these factors will apply:

- The nature of the Employee's position, experience and skill-set.
- Length of service with the employer.
- Nature of the industry.
- The time it would reasonably take the employer to find a proper replacement.

If you're making the Last Will there are 4 things that you should think about.

1.      Who do I want to leave my property to after I pass away?

2.      Who's the person that I want to appoint to take care of all of my property and affairs after I die?

3.      You need to think about any responsibilities you have to your loved ones to care for them after you die. Think children, think elderly parents.

4.      Once you put your mind to all of that, you'll get in contact with the lawyer and the lawyer will help you write your last will.
