Common law spouses may still advance family property claims, especially where
property has been acquired in a “joint
family venture,” or they have contributed to the acquisition, maintenance
or improvement of property owned by a common law spouse.
The property rights of common law spouses upon separation are not governed
by any Ontario statute.
