Simran Bakshi on Workplace and Employment Law: Another Blow to Employers – There is no saving a Termination Provision that is in part illegal


What happens if one provision in a section on termination of employment is unenforceable, but not another? The Court of Appeal considered this question in Waksdale v Swegon North America Inc, 2020 ONCA 39 and determined that "While courts will permit an employer to enforce a rights-restricting contract, they will not enforce termination provisions that are in whole or in part illegal.  In conducting this analysis, it is irrelevant whether the termination provisions are found in one place in the agreement or separated, or whether the provisions are by their terms otherwise linked."

The Supreme Court of Canada in Matthews v Ocean Nutrition Canada Ltd., 2020 SCC 26  was clear that  an employee who would have received a bonus during the notice period, but for her termination, is entitled to such compensation, unless the wording of the bonus plan unambiguously alters or removes this right.

You can definitely name somebody in your last will to have custody and guardianship of your minor children in the event both of the parents pass away.

Now, the appointment you make in you last will is temporary. That person will eventually need to apply to the court to be appointed as a permanent guardian. But, when they make that application, the court will look very closely on who you named in your last will, and factor that in the decision about who should be the permanent guardian of your children.

In the of NK v Botuik, 2020 HRTO 345, the Ontario Human Rights Tribunal revisited the concept of consent within the context of a workplace “relationship”.  The Tribunal declared that “manufactured consent which is secured by ignoring and overriding objections is not consent at all under the law…consent under the law does not extend to situations where a party complies because they fear the consequences of refusing”.
