Paul Adam on Wills and Estates: Adoptive Children


What are the legal rights of adopted children when a parent - biological or adoptive - passes away? If the Will makes a gift to "my children", does that include adopted children?

Under Ontario law, legally adopted children are generally presumed to have the same rights as biological children for estate purposes. A testator still has the freedom to make gifts and leave inheritances and specify that they are only for certain, specified children, if she chooses, so the question may depend on interpreting what the deceased intended and the wording of the Will.

Paul Adam on Wills and Estates: Providing for Guardianship of your Children in your Last Will


You can definitely name somebody in your last will to have custody and guardianship of your minor children in the event both of the parents pass away.

Now, the appointment you make in you last will is temporary. That person will eventually need to apply to the court to be appointed as a permanent guardian. But, when they make that application, the court will look very closely on who you named in your last will, and factor that in the decision about who should be the permanent guardian of your children.

A Last Will only determines what happens to your property after you have passed.
 
A Power of Attorney is used to appoint someone to manage your property and your medical care if you are incapable. It is no longer valid after death. 

In some ways, having an Attorney who can protect you while you are still living is even more important that having a will.

If you're making the Last Will there are 4 things that you should think about.

1.      1. Who do I want to leave my property to after I pass away?

2.     2.  Who's the person that I want to appoint to take care of all of my property and affairs after I die?

3.      3. You need to think about any responsibilities you have to your loved ones to care for them after you die. Think children, think elderly parents.

4.      Once you put your mind to all of that, you'll get in contact with the lawyer and the lawyer will help you write your last will.
