Paul Adam on Wills and Estates: Dying Without a Last Will

There’s a popular misconception that if I die without a last will everything goes to the government. That's actually not true.

If you die without a last will in Ontario there is a whole system in the law for who gets your property after you die.

If you have a spouse everything is left to your spouse, if you have a spouse and children everything is divided between your spouse and your children, and if you don't have a spouse or children everything is divided between your closest living family members.

Wise Law's Family #LawFact of the Day: Separating from your spouse in Ontario

Ontario Family Law recognizes separation of spouses who intend to live separate and apart even if they don't immediately live in separate residences.

Many couples live separate and apart “under one roof,” following marital separation, and do not immediately physically separate by changing residency.

Legal advice should be obtained as to whether a separation has occurred that would be recognized under Ontario law.

Wise Law's Employment #LawFact of the Day: Did you sign a non-competition agreement?

If your employment agreement prohibits you from competing with your employer or soliciting its customers after you leave, those restrictions may not be enforceable.

Non-competition agreements are generally unenforceable against Ontario employees.

Many non-solicitation agreements may also be unenforceable.

Seek legal advise if you have signed such an agreement.

Paul Adam on Wills and Estates: Can I make my own Will using an online form?

Beware. If you use an online form instead of a lawyer:

1. You aren’t getting personalized advice from a lawyer who has assessed your needs and interests.

2. Nobody is proofreading the document to ensure it is error free, and captures your intentions accurately.

3. Sadly, many online will forms include mistakes some that could adversely affect the interpretation of the Will.

Wise Law's Family #LawFact of the Day: Uncontested Divorce in Ontario

Separating spouses can file an Application for Divorce with the Court at any time following your separation.

Where matrimonial issues remain unresolve, a divorce judgement can still be issued after 1 year of separation. Any remaining issues can then be continued before the court in a "corollary relief proceeding.”

Wise Law's Employment #LawFact of the Day: Termination Without Cause

Can an employer lawfully terminate an exceptional employee who has had consistently good performance reviews?

Under Ontario law, an employer may terminate any employee without cause, so long as…

The employer provides reasonable notice, or pay instead of such notice, to the employee.

If you receive a termination letter, you may be entitled to additional compensation.

Don't sign any documents until you have received legal advice.
