Paul Adam on Wills and Estates: Is a foreign Will valid in Ontario?

This can depend on the Will itself. Some factors to consider are:

1. Does the Will intend to apply to property in Ontario?
2. Can the words of the Will be interpreted conclusively?
3. Does the Will deal with the property in a way that is legal in Ontario?

If the Court is satisfied with the answers to all of these questions, and an executor has already been appointed outside Ontario, it may grant that executor the right to administer the deceased’s property in Ontario, too.

Paul Adam on Wills and Estates: Estate Tax

There are 3 basic ways in which most simple Estates may be required to pay taxes.

1.      If all or part of your state is being submitted to Probate, you'll need to pay what's called an Estate Administration Tax on that portion.

2.      If you have to sell property or shares in a corporation, your state may need to pay Capital Gains Tax on the proceeds from the sale of that property.

3.      Lastly your Estate will need to file a tax return for the year in which you die until your Estate is wrapped up and all of the money is paid out.

Paul Adam on Wills and Estates: When should you make a Will?

The best time to time to prepare your Last Will is “right now.”
The end product is only half the benefit. You also benefit from taking stock of all your assets and responsibilities and from planning how you’d like to take care of your loved ones.

When you talk with a lawyer about your Will, you will get advice and clarity about these concerns and the steps you need to take to keep your affairs in order. There is no more important way to provide for your family and your future.

Paul Adam on Wills and Estates: What is Probate?

When you name a person in your last will to be the Executor of your Estate, that person sometimes needs to also apply to the Court to be appointed formally as the legal representative of your Estate in order to deal with certain property that you own, potentially like a house or a bank account that solely in your name.

The process of applying to Court to be appointed as the representative of your Estate is what we call Probate.

Paul Adam on Wills and Estates: If a family member has put money into an investment in your name and you have a co-signed on changes to the investment, does that investment belong to you?

The answer will very often depend on what you and your family member intended. Did they put the investments in your name with the expectation that you would hold it for their benefit, as a convenience, or was it done with the intention that the money was to belong to you?

Where there is a dispute, Ontario’s Courts will look at the documents or agreements you signed, the intentions of everyone involved and the surrounding circumstances to determine ownership interests.

Paul Adam on Wills and Estates: Providing for Guardianship of your Children in your Last Will

You can definitely name somebody in your last will to have custody and guardianship of your minor children in the event both of the parents pass away.

Now, the appointment you make in you last will is temporary. That person will eventually need to apply to the court to be appointed as a permanent guardian. But, when they make that application, the court will look very closely on who you named in your last will, and factor that in the decision about who should be the permanent guardian of your children.

Wise Law's Employment #LawFact of the Day: Common law entitlements upon termination

Do employees have different severance entitlements under the Employment Standards Act in wrongful dismissal cases that are decided in Court?

Ontario's Employment Standards Act provides only for employees' minimum notce and severance entitlements.

Unless an enforceable employment agreement provides otherwise, common law entitlements for non unionize employees can be as much as one month for each year of service.

You may be entitled to additional compensation.
