Ontario Wills and Estates #LawFact of the Day: How Does Marriage Affect Your Existing Will?
When a person is married in Ontario, the marriage automatically revokes a prior Last Will made by that person.
The sole exception to this rule is a Last Will that is specifically made in anticipation of an upcoming marriage to a specific person.
If you are marrying, seek legal advice as to any changes that are required to update your existing will and to ensure your will is valid.

Ontario Family Law recognizes separation of spouses who intend to live separate and apart even if they don't immediately live in separate residences.
Many couples live separate and apart “under one roof,” following marital separation, and do not immediately physically separate by changing residency.
Legal advice should be obtained as to whether a separation has occurred that would be recognized under Ontario law.
