Ontario Wills and Estates #LawFact of the Day: Compensation of an Estate Trustee


An Estate Trustee is entitled to be paid for the work they do on behalf of the Estate.

The compensation is 2.5% of each transaction in and of the Estate, and 0.4% of the average value of the estate for each year they act as Trustee.

Estate beneficiaries are entitled to challenge the compensation claimed by the Estate Trustee after the Trustee passes their accounts.

The OCL is an Ontario government agency that employs lawyers and social workers.

It works to provide independent information to the Court about a child’s needs, wishes and legal interests.

Ontario Wills and Estates #LawFact of the Day: Providing for Guardianship of your Children


You can leave instructions in your Will for who will have custody of your children after your death.

These custody appointments are valid for 90 days. After that, a Court must make a permanent custody order.

When deciding on custody of your children, the best interest of your children must be considered by the court and the Last Will will not always be determinative.
