For instance, a will cannot discriminate against a family member because of their…

Religion

In difficult parenting cases, a Court may request that the Office of the Children’s Lawyer (OCL) become involved to investigate and make recommendations to the Court or to provide legal representation for a child.

The OCL is an Ontario government agency that employs lawyers and social workers.

It works to provide independent information to the Court about a child’s needs, wishes and legal interests.

Ontario Wills and Estates #LawFact of the Day: Claiming Dependent Support from an Estate

Family members who were financially dependent upon a deceased person may be entitled to claim support from the deceased’s Estate.

If the deceased's will doesn't provide for these obligations, the support recipient can apply in court to request the support they are owed.

Under Ontario Succession Law Reform Act, support may be claimed by a spouse, parent, child, or sibling of the deceased. A court will decide on entitlement, amount and duration of the support.

Wise Law's Family #LawFact of the Day: Mediation of Parenting Disputes in Ontario

Many parental disputes in Ontario Family Law matters are now resolved through Mediation, rather than court action.

Mediators work with parents to create parenting plans and residency schedules that are tailor-made to provide for children’s needs and for joint parenting.

Both parties must  obtain independent legal advice to finalize any agreement reached in Mediation.

Wise Law's Employment #LawFact of the Day: Accommodating Pregnancy in the Workplace

Can an employer fire an employee whose pregnancy is causing medical complications that affect her ability to perform her usual workplace duties?

Employers have a duty to accommodate in those circumstances unless it would cause undue hardship.

This accommodation may include changing job duties temporarily or providing time off work.

It is unlawful and discriminatory if an employer improperly fires, demotes, or lays off an employee due to a pregnancy.
