A last will cannot have provisions that run contrary to public policy.

For instance, a will cannot discriminate against a family member because of religion, marital status, or sexual orientation and it cannot encourage people to do illegal acts.

A final Separation Agreement will document all issues that have been resolved by the parties signing it, along with any remaining actions, payments or arrangements required to complete the Agreement.


Additionally, a Separation Agreement will include extensive releases by both parties of all future claims they may have against each other regarding their property, support and estates.

Parties in Ontario civil cases are required to make full disclosure of all paper and digital documents that are relevant to the litigation, including documents that are not supportive of their cases.


In Superior Court cases, each party must deliver a sworn Affidavit of Documents that includes a complete listing of all relevant documents that are in the party’s power, possession or control. These documents must be produced to all other parties in the lawsuit.
