Simran Bakshi on Family Law: Unconscionable Agreements vs. Unconscionable Result: When may a Domestic Contract be Set Aside


While domestic agreements are intended to provide a degree of certainty as to the parties expectations in the event of a separation, provisions waiving support may not be enforceable if unconscionable in its effect.  As the Court in Scheel v Henkelman, 2001 CanLII 24133 (ON CA) stated, "an agreement which was fair and reasonable when it was signed, may, through circumstance that occur in the future, result in unconscionable circumstances at the time of a support application".

Simran Bakshi on Workplace and Employment Law: Ontario Human Rights Tribunal does not hold back in awarding Damages for Egregious Sexual Harassment in the Workplace


In the landmark decision of NK v Botuik, the Ontario Human Rights Tribunal awarded an employee $170,000 in general damages, marking the second highest award ever made in a sexual harassment case. The facts presenting in this case were egregious warranting such an award, including ongoing sexual harassment by a person of authority, sexual assault, wrongful criminal accusations against the victim, culminating in the wrongful termination of her employment.

Beware. If you use an online form instead of a lawyer:

1. You aren’t getting personalized advice from a lawyer who has assessed your needs and interests. 

2. Nobody is proofreading the document to ensure it is error free, and captures your intentions accurately. 

3. Sadly, many online will forms include mistakes -  some that could adversely affect the interpretation of the Will.
