Ontario Wills and Estates #LawFact of the Day: Compensation of an Estate Trustee

An Estate Trustee is entitled to be paid for the work they do on behalf of the Estate.

The compensation is 2.5% of each transaction in and of the Estate, and 0.4% of the average value of the estate for each year they act as Trustee.

Estate beneficiaries are entitled to challenge the compensation claimed by the Estate Trustee after the Trustee passes their accounts.

In Slepenkova, the Ontario appellate court upheld a two-month notice extension for an employer's bad faith termination, even though no evidence was led at trial as to the specific damages the employee directly incurred as a result of the bad faith. This appeared to place the trial Judge's decision at odds with the new Wallace test set out in Honda.
