Paul Adam on Wills and Estates: What is the difference between a Last Will and a Power of Attorney? Do I need both?

A Last Will only determines what happens to your property after you have passed.

A Power of Attorney is used to appoint someone to manage your property and your medical care if you are incapable. It is no longer valid after death.

In some ways, having an Attorney who can protect you while you are still living is even more important that having a will.

Paul Adam on Wills and Estates: Providing for Guardianship of your Children in your Last Will

You can definitely name somebody in your last will to have custody and guardianship of your minor children in the event both of the parents pass away.

Now, the appointment you make in you last will is temporary. That person will eventually need to apply to the court to be appointed as a permanent guardian. But, when they make that application, the court will look very closely on who you named in your last will, and factor that in the decision about who should be the permanent guardian of your children.

Paul Adam on Wills and Estates: How important is it to have a Will if you are in your 30s and don’t have many assets?

Having a Last Will is still important, even if you are young. There is no better way to provide for your family and your future.

You can create a Last Will to plan ahead for a time when you have increased assets or a larger family. Now is always a good time, because your life is only going to get more hectic!

Paul Adam on Wills and Estates: What is an Executor?

An Executor is the person who’s the legal representative of your Estate. After you die, your Executor is responsible for taking all of the assets and properties that you own and distributing it to your heirs. If you’re thinking about who should be your Executor, you want to name a person who is responsible, organized, a good communicator, and who keeps their head in a difficult emotional situation, and if you can pick somebody who lives in Ontario.

Paul Adam on Wills and Estates: Can I make my own Will using an online form?

Beware. If you use an online form instead of a lawyer:

1. You aren’t getting personalized advice from a lawyer who has assessed your needs and interests.

2. Nobody is proofreading the document to ensure it is error free, and captures your intentions accurately.

3. Sadly, many online will forms include mistakes -  some that could adversely affect the interpretation of the Will.

Paul Adam on Wills and Estates: Making a Last Will

If you're making the Last Will there are 4 things that you should think about.

1.      Who do I want to leave my property to after I pass away?

2.      Who's the person that I want to appoint to take care of all of my property and affairs after I die?

3.      You need to think about any responsibilities you have to your loved ones to care for them after you die. Think children, think elderly parents.

4.      Once you put your mind to all of that, you'll get in contact with the lawyer and the lawyer will help you write your last will.
