Did you know that a probationary period may go longer than three (3) months.

The Employment Standards Act does not impose a probationary status for employees. It simply provides that there is no minimum notice or pay in lieu of notice required for employees less than three months of service.

The Spousal Support Advisory Guidelines (SSAG) assist Ontario Courts in determining the amount of spousal support payable by a spouse. Unlike the child support guidelines, the SSAG’s are not binding upon the Courts.

Ontario’s Courts, however, are required to consider the SSAG’s and to provide reasons for any decision that does not follow them.

LawFact of the Day: Civil Litigation

Here is your daily LawFact from Wise Law for Thursday July 19, 2018.

Today we are talking about Civil Litigation.
Examinations for Discovery are oral examinations of a party to a lawsuit, under oath, that occur after a case has been commenced. The lawyer for the party being questioned is also present during the Examination, and may object to any irrelevant or improper questions asked.

During these Examination, the party may be asked questions by the opposing parties’ lawyers about all issues related to the lawsuit. Examinations are conducted at private facilities that provide court reporters for the examination,  and are able to produce transcripts on request.

Where all matrimonial issues have been resolved as at the one-year anniversary of a separation, an uncontested divorce can proceed by filing specified paperwork with the Court.

Where issues remain unresolved, a divorce judgement can still be issued, and remaining issues can then be continued in a “corollary relief proceeding.”

LawFact of the Day: Civil Litigation

Here is your daily LawFact from Wise Law for Thursday July 12, 2018.

Today we are talking about Civil Litigation.
Parties in Ontario civil cases are required to make full disclosure of all paper and digital documents that are relevant to the litigation, including documents that are not supportive of their cases.

In Superior Court cases, each party must deliver a sworn Affidavit of Documents that includes a complete listing of all relevant documents that are in the party’s power, possession or control. These documents must be produced to all other parties in the lawsuit.

The amount of notice to be given will depend on a number of factors, including the nature of the Employee's position experience and skill-set, length of service with the employer, nature of the industry, and the time it would reasonably take to find a proper replacement.

LawFact of the Day: Civil Litigation

Here is your daily LawFact from Wise Law for Thursday July 5, 2018.

Today we are talking about Civil Litigation.
Civil lawsuits in Ontario’s Superior Court are commenced by issuing a document known as a Statement of Claim. A Defendant who is served in Ontario must file a Statement of Defence within 20 days of service.

If a Defendant is served elsewhere in Canada or the US, a Statement of Defence must be filed within 40 days of service. If a Defendant is served outside Canada or the US, the Statement of Defence must be filed within 60 days of service.
