Ontario Wills and Estates #LawFact of the Day: Providing Guardianship of your Children
You can leave instructions in your Will for who will have custody of your children after your death.
These custody appointments are valid for 90 days. After that, a Court must make a permanent custody order.
When deciding on custody of your children, the best interest of your children must be considered by the court and the Last Will not always be determinative.

Wise Law's Family #LawFact of the Day: How do child support payments work in Ontario?
The amount of support payable by separated parents in Ontario is strictly governed by the Child Support Guidelines.
The Guidelines tables establish basic child support obligations and are based solely on the payor’s income, number of children, and Province of residence.
Additional amounts may also be payable to cover special and extraordinary expenses incurred for a child’s daycare, medical care, education and extra-curricular activities.
These additional expenses are shared by the parents in proportion to their respective incomes.

An employee is obligated to give reasonable notice of intention to resign from his or her position of employment.
The amount of notice to be given will depend on a number of factors including any provision in an employment agreement that sets out the amount of notice of resignation that is required.
Where there is no employment agreement that provides for resignation by employee, these factors will apply:
- The nature of the Employee's position, experience and skill-set.
- Length of service with the employer.
- Nature of the industry.
- The time it would reasonably take the employer to find a proper replacement.

Ontario’s Family Law Act (FLA) governs the equalization and division of property between spouses upon marital separation.

An Estate Information form is used by an Estate to certify the net value of its assets and to verify the Estate Administration taxes payable by an Estate.
An Estate must file an Estate Information Return with the Ministry of Finance within 90 calendar days after a Certificate of Appointment of Estate Trustee has been issued by the Court.

A family law Separation Agreement is a binding legal agreement signed by both spouses to document the resolution of all or some of the legal issues arising from their separation.
Both parties must obtain independent legal advice regarding the Agreement.
Separation agreements may be entered into by married and common law spouses. There can only be changes if both parties consent or if the court orders a variation.
