Under Ontario’s court rules, parties to all lawsuits
commenced in Toronto, Ottawa and Windsor are required to attend at mandatory
mediation to attempt to achieve settlement. Approximately 45% of cases settle
at mediation.
If all parties agree, mediation may also be conducted
in lawsuits commenced outside Toronto, Ottawa and Windsor, but mediation is not
mandatory outside these three jurisdictions.
